I would assume those in the know disconnect their 360s from Online until a new firmware arrives.

Yes it gets them around the problem for a time but M$ are never very mouthy over when the ban wave is coming - in fact I've never read anything about it until its happened and I follow xbox scene and few other sites often.

Even if they do think "oh its about time to get banned, will disconnect and wait for patch" it means we get a bit of them not online :P

November ish, a big update comes and with it comes the Ban Hammer, its widely reported across the net, so its not exactly a secret, just follow Kotaku.

Lets get back to the issue at hand here.

The homebrew that's out there at the moment just isn't advanced enough to do this.  All there is pretty much is crappy space shooters, a NES emulator and a half working backup manager.

Something else is afoot.

It seems Hotz and the group got hold of secret codes that identify software as legitimate to the PS3. These, in theory, could then be attached to pirated software and games, allowing them to run on the system.

According to the Guardian, the group's defence will probably centre on the precedent of ‘fair use' established last year. In other words, this is just good, old-fashioned jail-breaking, and thus OK. Sony seems to want to re-establish precedent by making jail-breaking of its PS3 software illegal
