Coming back from Sainsburys a bloke in a Lexus drove into the side of the car, it was just a light scratch so i told him not to worry i wouldnt take it further and he shook my hand.

I had a knock at the door, the gentleman expressed that my car was in fact his stolen car, which had been reported and the case open/shut because there was no case. (I ascertained this by following it up with the DVLA/Police)

The car had been owned by his son and the sons girlfriend, each of the couple had keys to the vehicle, however the gentleman had the history, but the car was registered in the girlfriends name. I do not know who actually paid for the car, but the conclusion met by the police is that this was a civil matter and i presume either a 50/50 situation or was actually paid for by the girlfriend and due to the gentleman or his son feeling bitter about the split up, they decided to report the car as stolen.

The gentleman of the son is now making an appeal against the decision in small claims court, however as per the facts above no one actually knows if he has any rightful ownership or part ownership of the car.

The facts still remain, the car was MOTd and sold at auction, fully HPId, not declared as stolen, and confirmed not stolen, its then been taxed and insured by myself who has been driving it for several months, and still has not been registered as stolen.

Crazy. Have any of the serial numbers been tampered with?

If I were in your shoes Id ask him what his court costs will likely be, and offer him the car back for that price. But then Im probably too dotoku (moral).

Id do something similar but not out of morality, but the fact that if the family is in the kinds of circles with parents going round in the middle of the night forcing steering locks and pseudo-stealing cars, if he loses the court case I would half imagine waking up one morning to find the car gone, or trashed out of spite. At least if they buy the car back you wont be out of pocket too much and theyll be off your case then.

As to the lexus driver at the start, Lexus drivers I find are 50:50 going to be dicks. They arent like the Audi and BMW drivers when you see them you know theyre going to cut across the roundabout in the right lane which is only for going right etc, theyll either be very polite and courteous, or mahoosive dicks.

Tell him to get stuffed. If it was in the g/f name and she sold it, tough luck on him.

Let him take you to the small claims court and watch the judge laugh @ him.

It gets even worse, he posted a copy of his court summons today through my door, the back story is building like an episode of Jeremy Kyle.

I’d tell him to sod off if he knocked on my door again! and that he should sort it out with the former legal owner of the car his son’s ex.  

While he did get screwed over by her it is nothing to do with you as you bought the car legally and she sold it legally as the registered owner, more fool him for putting it in her name tbh!  I guess there is no finance owed on the vehicle as that would have shown up in the HPI check, so he hasn’t got a leg to stand on.  

I really do fail to see any reason for not putting a car under his son’s name in such circumstances? ...common sense says to me you just would! if what he is saying to you is above board.

Yeh there is something not right about it, if he bought it why would he put it in someones elses name that is not a direct relative.

Yesterday he also posted a copy of his V5 through the door, meaning he had applied for a V5 at the sametime as me, i really dont see how that can happen, but he has a V5 for my car showing 5 previous owners and i have one too showing the same.

Im bit annoyed about that

Inform him that if he continues to harass you you will be forced to take legal action of your own against him in the form of a restraining order ><

Yes, this is turning into harassment now as far as I can see. I would be having a chat with the police about how you can stop him being a nuisance, its not acceptable behaviour.

then shut the door and go back to what you were doing

No no its all fine, ill wait until his court date and see what happens, ill either get to keep the car or i wont, in the event i lose the car the auction centre will refund me.
