Its not quite the same so the best they could hope for is inspired by, you dont get anything for that and the chances are it just looks very similar. I suspect though that the designer will claim they never saw the photograph at all if it comes to court.

There was a famous one a few years back when an artist that was doing Judge Dread mags copied the picture of a model from Playboy (IIRC). While the magazine kicked up some publicity about it the thing never went anywhere near a solicitor, never mind court. The artist freely admitted he did the deed and had done other offences so previously.

The mag even gave him a free sub!

Serious as it says in the article the angle of the pens is the same and the creases in the clothing, there is also the way the children sit and the ditance as a ratio between them.

He should be given an apology, then agree to let them use the image. It was probably an honest mistake somewhere down the line.
