Is that the same as being "declared incapacitated" ?

This is a very tricky subject.

I recall a case where someone of a very low IQ with obvious learning disabilities groping and molesting a young girl. His carer refused to do anything about it, "he's a bit slow dear, don't take offence."

The police were called and no charges were filed because of the man's condition. Essentially he was given carte blanche to continue to do the same thing to anyone else with no fear of reprisal.

I don't care what learning disabilities or handicaps you have or how low your IQ is, it is no excuse for such disgusting behaviour. When a person does that to a fellow human being they have demonstrated that they are a danger to other people and they should be treated accordingly.

In this particular case there seems to be more going on than is immediately being reported, perhaps a healthy dose of homophobia, but in general I support the idea of people who are mentally disabled being prosecuted to the fullest extent of the law for their crimes, being stupid isn't a defence.

To be honest it serves to highlight a major failing of the system that these people aren't looked after better in a more suitable environment and assigned carers who can prevent this kind of situation from occurring in the first place. I don't blame them, they clearly may not know the difference between right and wrong when it comes to sex, but I do ask that they pay for their crimes against other human beings.

Having seem some of the feral children with disturbing sexual deviants with "learning difficulties" seemingly making them immune from prosecution that my better half has taught at a number of different schools now this is only going to be a problem that will get worse.

In this perticular case it sure is tricky, if he ha a relationship with and lived together with a man he probably would not be a bother.First I thought, he had been bothering girls, when reading the title which would've been different.
