Criminal Damage

Okay last night my friend has being getting harrasment and death threats from some charv. I left my car in a lit car pack on a major road. The charv ended up smashing my windscreen, smashing at body work and slashing all four tyres.

They where arrested lastnight yet let off today with a caution due to "not being in trouble with the police recently"

Do I take this to court now? What do I do from here?

Im guessing damages on a rough scale of:

Ã,£30 per tyre Ã,£120
Ã,£60-Ã,£90 for a new windscreen
Ã,£40 for the body panel to be fixed and touched up.


Any help would be appriciated..




(Please dont jsut reply with "yeahhhh take her to court" because thats not helping I need information on what court of law and who I should be seeing. Thanks :) )

surely if they have been let off with a caution its too late to press charges? tbh i dont know how it works so i could be wide of the mark

Im still waiting for the full reason of why she was let off with a caution, I will find out tomorow.

You can still go to a civil court over the civil offense - shes only not been charged with a criminal offense. Can you prove it is the question?

get receipts for everything

what evidence do you have that she did this to your car? Did she admit to it when cautioned by the police? Best find out if you want the cash from her tbh...

tis two different things - hes after payment for damages the police are after a conviction etc...

I.e. someone can commit an offence against you - the police/CPS persue them through the criminal courts in order to punish them etc... you can also persue them through the civil courts for compensation.

sometimes you get situations like OJ Simpson where the burden of proof is less in a civil court - i.e. he got found not guilty in the criminal case but was successfully sued in the civil case

Ive got a form for Comensation Claim that I will fill in and give to the officer that is dealing with the case. Im shocked she has only got a caution with the death threats to my friend and all...

Thing is if the person is to poor to be able to afford to pay out the compensation what am I meant to do then? I have a family silistor/lawyer, that will be able to deal with the case for me.

if it goes through the small clams court, and your only suing for the damaged property (no crap like stress etc..)  then it doesnt;t really matter (within reason) how much money she has... maybe she can argue shes skint, but worst case is she pays off Ã,£10 a week etc...

.... Im not sure, but theres a chance the court can give you the money, then theyll wait and get the tenner r(or whatever) a week from her :o

Disgusting what the scum can get away with these days.

I would press ahead. The Police will have her details, etc.
Obviously shell get somesort of legal aid  :roll:

The CPS really should have taken this up with Criminal Damage & she Should not have been left off with a Caution.


Thought about going to the Papers? Im sure Sun Columinst John Gaunt may be interested in hearing about the case.

Dont worry if she cant afford to pay, depending on her age, then the parents may be liable.. Money can be taken direct from the Giros/Wage before it gets to them.

i doubt there is anything you can do tbh if you went to claims court then she just wouldnt turn up or be deemed to poor to pay or somthing.

Best bet is to just go and sort the bitch out.

Ive had people saying roughly this all day:
* Adress please? We wil go sort her out..
* Ive got favours owed from some nasty peole I can call one in for you
* Just smash the door in and take property to the value of
* We will torch the house for you

etc etc Id rather not.

Im going to have a chat with an officer tomorow, Im able to get details about her enough to proove a case from areas I have an eye witness. Ive got enough to convict her and proove it was her. I cant stand to loose this kind of money on repairs. So its off to the courts for gav yay :) I will look cool dressed neatly with me mohawk up hahah!
