Advice please

Ive got a dispute with an online store.  I bought an iPod hdd back in may and its failed.  The shop are claiming it was brand new, despite it having sticky marks all over it from the original damping and a 2003 manufacture date.

I paid £102 for this 40gb hdd and they are claiming it only has a 3 month warrenty.  
How can I take this further?

I paid via credit card into my paypal account.

Contact their local trading standards & any "bodies" they belong to.

3 month warranty is only normally given on refurbished items.

so you bought a brand new item that turned out to be used and you didnt send it straight back? why?

Should have sent it straight back, otherwise it should be covered by the makers warranty and that is through the seller.

Sorry to say this, but I think you shot yourself in the foot.  As said before you should have sent it back immediately.  Now there is no evidence to back up your claim.  Think you may be fighting a losing battle tbh.  :roll:
