You never mentioned before that you had passengers.  If they werent there how can they decide what you saw?

tbh i think you have been ill advised, even if they think with their hearts not their heads, his excessive speed which ultimately lead to his death also caused you serious injury and could have killed you, its 100% all his fault and if i were in that situation wouldnt take any blame no matter what the cost might be.

lol, I know, but by the time I knew I was being screwed it was too late :(

I should have had a "hypothetical" brainstorming sesion with my solicitor tbh :o

its the dumb ass system, wtih a judge we can say its un-reasonable to expect me to look 90 left 90 right and straight ahead all at the same time.... but with the magistrates they say he was there for 3.1 seconds and I should have seen him.... and it apparently doesent matter that even if I had seen him I wouldent have been able to do anything about it :(

^^ not without a load of hastle, the solicitors were up for it, but its taken a year to get this far


I was mad as hell at first, but now I just think screw it.

6 points is a bit rough, but its not the end of the world, and the fine wont be big ;)

What were you charged with?

As if its moved to sentencing, youve just been found guilty of that charge.

You cant be pleaing guilty to "being involved" as thats admitting fault! not just "being involved". It stands to reason the fact you are even in the court is because you were involved.

For your sake I hope the original charges were not "death by dangerous driving" as without a not-guilty plea it is unlikely the magistrates even changed the original charge.

In other news, my friend got her punishment taken to 4 points and hefty fine, with the charge of driving without due care and attention, after her appeal this afternoon. So shes got her licence back :) woo! :).

If it means you can plead not guilty, get no points or fine and the solicitors are willing (I assume they think its a good idea?) then surley its a good option even if it is alot of hassle?

M3ta7h3ad, Im only charged with carelss driving... if they thought it was my fault it would have been "death by...."  or something along those lines..

tho on a side note, theyve phoned me 3 times today changing the date for me to go back :o

What about your insurance? if you admit to careless driving then the family will have the option of trying to claim against your insurance and that would mean saying goodbye to any NCB plus they could slap some extra costs in for good measure.

^^ thing is, they all agree the accident was caused by his excess speed, were both insured either way no matter whos fault it is, plus Im personally covered by my employers liability insurance too :)

This just makes no sense, if everyone is saying he was at fault what exactly are you guilty of other than being there?

not to bad tbh, could have been worse... and I didnt even need to use the "I need my driving licence" defence :)

If it had been me I would have dragged it through every possible court for as long as possible until Id won, but then thats just me.
