Bloody typical. 2 weeks ago I take my bike for its first service, £200 later its like new with much of the gearing brand new.
Tuesday night I go and get my hair cut and the keen cyclist lady who is cutting my hair is telling me about a time a car pulled across a junction in front of her making her go over the bonnet, breaking an arm and leg. I said "Luckily, its never happened to me."
Thursday night, what happens? Youve guessed it. A car pulls out of a drive way when Im only about 6 metres away, Im doing about 20mph, downhill. Cant stop in time, straight into his drivers door.
Generally, I felt fine, although I did have a big bump above my right eyebrow and so my house mate insisted he took me to A&E. Had the usual things checked out, but also a pelvic scan. Given the all clear. But the bike, knackered. Im doing a triathlon next weekend so have had to borrow a bike off a friend.
Im so frustrated. At least I got the drivers details and hes already reported it to his insurance company. Fingers crossed they pay out, I fear the bike frame may be shot :( Certainly the front wheel and front forks are.
That is a drag :( lucky you werent doing 50 on a motorbike though.

insurance isnt just for bones. its to return the injured party back to the state they were in pre accident and offer compensation where that cant be done.
hence why you claim bus tickets if your car is written off. so inn your case, the cst of hiring a bike etc etc.
you didnt ask him to get in the way. so why let it put you out of pocket. just dont take the piss and claim for whiplash then go the triathlon.

Good man. As someone who is currently going through the claims process (my better half was in a rather serious car accident last year) nothing annoys me more than people claiming for injuries they havent received, it really is beneath contempt.
Ive done it, once. When I got knocked off my motorbike the first week I was working at Tekheads.
Broken leg, smashed bike, and being my first week, no sick pay. Took 2 years to get a payout.

But this is insurance, rather than injury claims.
the injury claim is made against the insurance of the person at fault.... so its the same thing really...
edit: p.s. good on you for not putting one in.... Ive had people make them against me in the past.... and even a guy at work (before I was the boss) crashed his car drunk driving, then put in a claim against my dad saying he hurt his neck at work ! (he didnt get any money..... but it cost us 12k in solicitors fees!)

Well to me its only the same in the sense of 6 and two threes. Might be against insurance, but its one thing getting the insurance to pay for bike repairs and covering rental etc as in the sense of a normal crash, its another taking legal action to get more out of the insurance company.
Bit cheeky of the guy at work, was he about to be laid off and trying it on, or what?!

oh right, I see what you mean now, I got the wrong end of the stick there, I agree, repairs = fair, fake/inflated injury claim = bad
and for the guy at work.... nope... he was just a moron.... thought he was going to get 50k because he said some boxes fell on his neck..... inside the small freezer that was only 6 foot high.... and did I mention it was his job to clean/sort/organise that freezer ? even worse is..... he must have know he wouldnt last long after that... so he tried to nick the float out of the till..... and was caught and fired for it on the spot.... so he tired to sue for wrongful dismissal !!! but he didnt get anything then either :D
Is it possible to counter sue people like that to claim back stuff like the legal fees and loss of earnings due to the hassle and time off? I bet itd make a lot of people think twice if they didnt have a legit claim if they had the possibility of ending up having to fork up for it all...

Back to the original topic, I spoke to the drivers insurance company today and hes accepted full liability. Hes been honest, its only fair on everyone that Im honest. The insurance company asked me about injuries and asked if I wanted to claim compensation for any, I declined. Just want my bike fixed/replaced and Ill be happy again.
